Ezora Health Terms of Service

Welcome to Ezora Health! These Terms of Service ("Terms") govern your access to and use of the website located at https://ezorahealth.com (the "Site") and the services and products offered by Quelo LLC, doing business as Ezora Health ("Ezora," "we," "us," or "our").

Please read these Terms carefully.

By accessing or using the Site or purchasing our products, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must not access or use the Site.

1. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to use the Site or purchase our products. If you are under 18, you must have parental or guardian supervision. Parents or guardians are responsible for all purchases and actions made by minors.

2. Products and Services
Ezora offers health and wellness products, including magnesium gummies and hydration supplements. All descriptions, pricing, and availability are subject to change at any time without notice. We reserve the right to limit quantities or discontinue any product. Products are manufactured by third-party contract manufacturers. While we conduct quality control reviews, we disclaim all liability for errors, contamination, injury, or adverse reactions related to third-party manufacturing. You agree that use of our products is at your sole risk and responsibility.

3. Orders and Payment
All orders are subject to acceptance. By placing an order, you represent that you are authorized to use the selected payment method. Prices displayed do not include taxes but may or may not include shipping. Orders may be canceled by Ezora for any reason, including errors in pricing or suspected fraud. Title and risk of loss pass to you upon delivery.

4. Shipping and Delays
Shipping times are estimates, not guarantees. Ezora is not liable for shipping delays due to third-party carriers, customs, natural disasters, or other force majeure events. If products arrive damaged or are incorrect, contact us within 7 days to request a replacement. Refunds will only be issued in accordance with our Return Policy.

5. Subscriptions
By enrolling in a subscription, you authorize recurring charges to your payment method at the stated frequency and price until canceled. Subscription billing will continue unless canceled before the next renewal date.To cancel:

  • Log in and cancel your subscription via your account dashboard
  • Or email hello@ezorahealth.com using the registered account email

We may send renewal reminders as required by law. Subscription charges are non-refundable once a billing cycle begins, unless otherwise required by applicable consumer protection laws.
You acknowledge that you are responsible for all subscription management, including cancellations, shipping address updates, and payment method changes.

6. User Accounts
You must create an account to access certain features. You are responsible for maintaining confidentiality of login credentials and for all activities under your account. Ezora is not liable for unauthorized access or changes unless caused by gross negligence or willful misconduct.

7. Intellectual Property
All materials on the Site, including text, images, product packaging, logos, and trademarks, are owned or licensed by Ezora. You may not copy, modify, transmit, publish, sell, or otherwise exploit any content without our prior written consent.

8. User Content and Testimonials
By submitting reviews, social posts, images, testimonials, or other user-generated content ("UGC"), you:

  • Grant Ezora a worldwide, perpetual, royalty-free, irrevocable, sublicensable license to use, reproduce, publish, and adapt such content for marketing or any lawful purpose
  • Waive any right to approval, royalties, or attribution
  • Confirm you have rights to use all likenesses, logos, or intellectual property in submitted UGC

If you are compensated or incentivized to submit content, you agree to disclose your relationship as required by FTC guidelines.

9. Health Disclaimer
Ezora products and statements have not been evaluated by the FDA. They are not intended to diagnose, treat, cure, or prevent any disease. The content on our Site does not constitute professional medical advice. Always consult your doctor before starting a new supplement, particularly if you are pregnant, nursing, or have a medical condition.You accept full responsibility for your use of Ezora products and waive any claims against us related to allergic reactions, adverse effects, or misuse. Our products are manufactured in facilities that may process milk, soy, gluten, eggs, tree nuts, and other allergens. Always read ingredient labels carefully.

Ezora is not responsible for allergic reactions or cross-contamination.Individual results may vary. Ezora makes no guarantees of any specific health or performance outcomes. Customer testimonials reflect personal experiences and are not intended to represent typical results. Not intended for use by persons who are pregnant, nursing, or under age 18 without the approval of a healthcare provider. By purchasing or consuming our products, you acknowledge the inherent risks associated with dietary supplements and agree to release, indemnify, and hold harmless Ezora and its affiliates from all liability arising from such use.

10. Mobile/SMS Messaging
By opting in to SMS updates, you agree to receive promotional or transactional texts. Consent is not a condition of purchase. Message and data rates may apply.
Frequency may vary. You may opt out by replying STOP. For assistance, reply HELP or contact hello@ezorahealth.com.

You confirm that you are the subscriber of the mobile number provided and agree to notify Ezora if it changes.

11. Prohibited Conduct
You agree not to:

  • Violate any laws or regulations
  • Interfere with Site functionality or access
  • Use bots, spiders, or automated data scraping tools
  • Post or transmit unlawful, harassing, defamatory, or misleading content
  • Impersonate another person or misrepresent affiliation
  • Attempt to bypass security systems

13. Indemnification
You agree to indemnify, defend, and hold harmless Ezora, its owners, officers, affiliates, and contractors from and against all third-party claims, liabilities, damages, and costs (including legal fees) arising from:

  • Your breach of these Terms
  • Your use or misuse of our products
  • Your UGC submissions
  • Your violation of laws or rights of any third party

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EZORA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO EZORA IN THE TWELVE (12) MONTHS PRIOR TO THE INCIDENT.

Some jurisdictions may not allow limitations on liability, so these provisions may not apply to you in full.

15. Governing Law

These Terms and any disputes are governed by the laws of the State of Wyoming, excluding its conflict of law principles. Any claim must be brought in the proper arbitration forum as described below.

16. Dispute Resolution and Arbitration
All disputes shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Cheyenne, Wyoming. You and Ezora waive all rights to jury trials and class actions.You agree to resolve any disputes individually, and not as part of any class or representative action. Each party is responsible for its own legal fees, unless the arbitrator decides otherwise.

17. Changes to Terms
Ezora may update these Terms at any time. We will post the revised version with a new effective date. You are responsible for reviewing the Terms periodically. Continued use of the Site constitutes acceptance of any updates.
